Retainer Fee
Upon completing this contract, Client understands that there will be a 50% retainer fee for photography services. Please be sure to read the cancellation policy.
Covid Addendum I: Clients are encouraged to wait to place their deposit until they’re comfortable with the state of COVID-19; however, deposits are to be made no later than a month before the ceremony takes place.
Provided Documentation
All documentation created and provided to Client is owned and copywritten by Karly Underwood and may not be sold to third parties for compensation. Karly Underwood reserves the right to use images from your event on her social media page and in marketing materials. By signing this contract you hereby grant Karly Underwood Photograhy permission to use images of everyone in the photos including minors.
Promised Documentation
Of course Karly Underwood Photography wants to go above and beyond your exceptions, but does not agree to provide anything further than what is listed in your selected package. Karly Underwood Photography cannot be held accountable for promises made by third party vendors.
Destination Weddings
For all weddings deemed as destination (taking place beyond 125 miles of Karly Underwood’s place of residency) additional fees are applicable, such as round trip airfare, hotel stay for 2-3 days & 1-2 nights pending complexity, and car rentals from airport and back during the stay. All travel can be arranged by clients per specifications of Karly Underwood Photography or arranged by Karly Underwood Photography with agreement of payment invoiced.
Second Photographer & Family Photographer Policy
If budget allows, Karly Underwood Photography may hire a second photographer to assist in weddingday photography. This photographer will be of Karly Underwood Photography’s choice; client should understand that Karly Underwood Photography has high standards in selecting this candidate.
If there is an additional photographer present (including relatives with DSLRs / camera phones) at the wedding not associated Karly Underwood Photography, Karly Underwood Photography reserves the right to ask them to put their devices away. Karly Underwood Photography is a professional service and wants to ensure all of the photos captures are its own.
Liability
It is understood that Karly Underwood Photography is only liable for services completed and provided by Karly Underwood Photography and cannot be held liable for the services of other contracted vendors. It is understood that in no event shall Karly Underwood Photography be liable for consequential damages of any kind or material not produced.
Cancellation Policy
If event is canceled, no portion of the retention fee paid (50% of agreed upon total) to Karly Underwood Photography will be returned. If the event is postponed, services contracted can be applied to a new date if available.
Responsibility
Karly Underwood Photography is not responsible for acts of God, natural disasters, an act of government such as a declaration of national or local emergency, or other incidents not within the control of the consultant, i.e. accident, death in the family, illness, pregnancy, or sudden tragic circumstance. In such a situation, consultant will obtain, upon approval of the client, a qualified professional replacement to fulfill consultant’s obligations under the contract, at no additional charge to the client.
Courtesy Clause
Due to the extensive timeframe in which Karly Underwood Photography is expected to performed services, Karly Underwood Photography will take a break to eat meals and use the restroom. Discretion regarding the event’s timeline will be considered. Karly Underwood Photography asks for the provision of one (1) vendor meal per photographer hired.
Additional Image / Re-editing Requests
Karly Underwood Photography will provide the amount of photos agreed upon based on the package you choose. Karly Underwood Photography will honor requests for seemingly missing photos from critical events (usually resulting from upload errors) but will not honor bulk re-editing requests (more than 10 images). It is the responsibility of the client to be familiar with Karly Underwood Photography’s artistic style. Booking an engagement photoshoot is encouraged so that client can familiarize itself with Karly Underwood Photography’s artistic style.
Accompanying Engagement Photoshoot Conditions
Out of respect for Karly Underwood Photography’s time, if a package has been booked that includes a 30 minute photoshoot, location must be in the San Jose area. Karly Underwood Photography is willing to travel within the San Fransisco Bay Area for 1 hour engagement photoshoots. Engagement photos cannot be exchanged for monetary value and is deemed a “use it or lose it” offer. Engagement photos will be returned within 14 days.
Damage or Loss of Accessories
Client agrees to exercise all due care in caring for, and preserving the property of Karly Underwood Photography. Clients shall remain responsible for all loss or damage to equipment, up to and including actual replacement value for each missing or damaged item per cost.
Attorney
If legal action is necessary to enforce the terms of this contract the prevailing party shall be entitled to reasonable attorney fees in additional to any other remedies to which that party might be legally entitled.
Appropriate Conduct / Safe Working Environment:
The Client(s) expressly agree(s) to take best efforts to provide Karly Underwood Photography and Karly Underwood Photography’s staff with safe and appropriate working conditions. In the event of circumstances deemed by either Karly Underwood Photography or a bystander to present a threat or implied threat of injury or harm to Karly Underwood Photography staff or equipment, Karly Underwood Photography reserves the right to cancel all services remaining under this Agreement and leave the event. At Karly Underwood Photography’s discretion, Karly Underwood Photography may enact a three-strike policy. After the first offense, Karly Underwood Photography will make reasonable efforts to notify the Client(s) or a responsible party. If the Client(s) is/are able to respond to the threatening situation in a reasonable amount of time (maximum of 15 minutes), Karly Underwood Photography shall resume work in accordance with the original terms of this Agreement. If the threatening behavior occurs for a second time, the Client(s) will agree to remove the offending person for the remainder of the event. If the behavior occurs a third time, the Karly Underwood Photography will immediately leave the event. If Karly Underwood Photography leaves the event early due to any offending behavior, the Client(s) expressly agree to relieve and hold Karly Underwood Photography harmless as a result of incomplete event coverage, or for a lapse in the quality of the Karly Underwood Photography work, and the Client(s) shall be responsible for payment in full.
COVID Addendum II: It is the clients responsibility to notify Karly Underwood Photography if anyone in attendance of wedding ceremony has been tested positive for or exposed to COVID-19 two weeks prior to event so that a new assessment can be made. Failure to do may result in cancelled services or legal action if Karly Underwood Photography is knowingly exposed without warning.
Payment Schedule and Method
For your convenience, payments can be made online via karlyunderwoodphotos.com using a valid credit card. Otherwise, payment is to be made by cash. A 50% initial retainer fee is due upon booking (See COVID Addendum I). 25% of the total is due in exchange for engagement images or a month prior the wedding day. The remaining balance is due at the time of the gallery’s completion with a 10% late fee applied each week thereafter.
