Details

  • Style: A healthy blend of guided poses and candid moments in a warm, moody style.

  • Rate: $350 per hour unless otherwise negotiated – 50% due at the time of booking via invoice, Zelle, Venmo, or PayPal.

  • Coverage: All edited high-quality images (no RAW files) delivered via a personalized online gallery.

  • Gallery Content: Typically 30-50 images, with variations based on factors like punctuality, client cooperation, and weather conditions.

  • Location: Sessions take place in the San Jose area unless otherwise agreed upon; no studio facilities are provided.

  • Props: Clients are encouraged to bring any desired props (e.g., balloons for a first birthday shoot, sonogram for a maternity session, etc.).

  • Turnaround: Expect your completed gallery within 14 days.

Photography Contract

PERFORMANCE OF SERVICES

Photographer agrees to provide professional photography services and produce high-quality images suitable for web display and print. Photographer will utilize professional hardware, software, and editing techniques consistent with Photographer’s established artistic style. Client acknowledges responsibility for reviewing and familiarizing themselves with Photographer’s portfolio and creative style prior to booking. RAW images will not be provided under any circumstances.

PACKAGE TERMS

Photographer will perform only one type of photoshoot per paid session. Any modifications to the selected package, including but not limited to the addition of parties, pets, or other participants, must be requested and agreed upon by Photographer prior to the scheduled session.

PAYMENT

Full payment is due at the time of booking to secure the session date. Upon receipt of payment, Photographer agrees to deliver the final edited digital images within fourteen (14) days following the session. Client acknowledges responsibility for reviewing Photographer’s editing style prior to the photoshoot and agrees to communicate any editing concerns before the session takes place.

Payment may be made via invoice, Venmo (@kuphoto), or Zelle using 765-465-9916.

THIRD-PARTY VENDOR PAYMENT POLICY

If Client is booking photography services for a party or event, Client understands and agrees that Karly Underwood Photography will not distribute or deliver payments to any third-party vendors on Client’s behalf.

CANCELLATION POLICY

If Client cancels the session, all payments made will be refunded except for a non-refundable $50 cancellation fee.

TRAVEL

Photographer agrees to provide services within Santa Clara County, California unless otherwise discussed. Sessions located outside Santa Clara County may incur additional travel fees, which will be disclosed and agreed upon during consultation or at the time of booking.

WORK PRODUCT OWNERSHIP

All photographs and any associated copyrightable works, concepts, or products created during the session (collectively referred to as “the Work”) remain the sole intellectual property of the Photographer. Ownership and copyright of the Work do not transfer to the Client under any circumstances. To preserve this ownership, RAW image files will not be delivered.

REFUND POLICY

All sales are final. Refunds are not available except as otherwise outlined in the Cancellation Policy.

LATE-TO-SESSION POLICY

Client agrees to arrive on time for the scheduled session. The session will begin and end at the agreed-upon time regardless of Client arrival. Late arrival may result in reduced session time without refund or extension.

IMAGE ARCHIVE

Final images will be available for download for eight (8) weeks following the session date. After eight weeks, images may be permanently deleted and may no longer be available for retrieval. Photographer is not responsible for maintaining image archives beyond this period. Client agrees to download and securely store all delivered images upon receipt. Photographer reserves the right to retain select images for portfolio and promotional use.

MODEL RELEASE

By signing this agreement, Client grants Photographer the unrestricted right to use images from the session, including those containing minors*, for marketing, portfolio, website, social media, advertising, and other promotional purposes. Client waives any right to inspect or approve the finished product or published material.

*Client may request specific exemptions regarding images of minors prior to the session.

LIABILITY RELEASE

Client agrees to comply with all applicable local, state, and venue guidelines related to health and safety, including but not limited to public health recommendations when applicable. Client agrees to notify Photographer of any illness or recent exposure that may affect the safety of the session so that Photographer may assess potential risk without penalty to Client.

ASSUMPTION OF RISK

Client acknowledges that participation in a photography session may involve inherent risks and voluntarily assumes full responsibility for any injury, illness, or damages that may occur to themselves or accompanying participants during the session. Client hereby releases and discharges Photographer from liability for any such injury or illness.

INDEMNIFICATION

Client agrees to indemnify, defend, and hold harmless Photographer from and against any and all claims, damages, medical expenses, judgments, legal fees, and other litigation costs arising from or related to the photography session.

DURESS

Client acknowledges that they are signing this agreement voluntarily and without coercion or duress and that they have been provided adequate opportunity to review the terms prior to signing.
